Count 1: The Iraq war was a crime of aggression. |
It is only a war of aggression if the UN does not approve it. The UN approved this war twice.
Once with the authorization of Resumption of Hostilities if Saddam does not abide by the Armistice signed at the end of the First Gulf war. Note I said Armistice, not treaty. The treaty would have been signed if Saddam had complied with the resolutions. Each time Saddam willingly fired on any coalition aircraft, that was a violation, let alone all the other violations he committed by ignoring all seventeen resolutions that followed. UN Resolution: 686 Para:
3(a) "Cease hostile or provocative actions by its forces against all Member States including missile attacks and flights of combat aircraft."
Second UN resolution 1441 gives a list all the volitions of 686 and 687, and warns Saddam
again about firing on Member State aircraft supporting the UN resolution 686 and 687. Which he ignore and fired upon British aircraft the next day. Also This is the Resolution that also authorizes serious consequences if he does not follow this warning and all seventeen resolutions that he had ignored.
Count 2: The conduct of the war involved the commission of "war crimes." |
The UN Nuremberg Charter goes into detail what is "War Crimes", none of which has been Violated. So please if you want to make this statement detail out your charges as per which Crime was committed. As for using count number one as the charge, I have already taken that one off the table.
Count 3: The occupation of Iraq involved, and continues to involve, the commission of "war crimes", "crimes against humanity" and other illegal acts. |
Please, detail out what crimes against humanity you are talking about and illegal act. Right now your saying "things", please tell me what the "things" are. I am not a mind reader.
Count 1: The Bush administration authorized the use of torture and abuse in violation of international humanitarian and human rights law and domestic constitutional and statutory law. |
Again please detail on what violates the "international humanitarian and human rights laws ect..." and provide the memo/Field manual/Regulation authorizing the torture from the administration. I can provide the Army Field Manual dealing with the Geneva Convention and detailing how the US Army is regulated to protect human rights. Every member of the US Army goes through a briefing at least once a year and it is a required Common Task to be tested on yearly. I must have missed the memo authorizing me to torture people.
Count 2: The Bush administration authorized the transfer (“rendition”) of persons held in U.S. custody to foreign countries where torture is known to be practiced. |
You mean we are not authorized to return the persons to there own countries? What your asking us to not return persons to their own country to face charges and justice, because that country will enact their laws that don't follow ours.
Count 3: The Bush administration authorized the indefinite detention of persons seized in foreign combat zones and in other countries far from any combat zone and denied them the protections of the Geneva Conventions on the treatment of prisoners of war and the protections of the U.S. Constitution. |
One: Those captured in foreign combat zones do not meet the criteria of "prisoners of war", by the Geneva Convention (again I am brief on and tested on the Geneva Convention once a year, how about you?).
Two: Please point out in the US Constitution where foreigners outside the United States have the rights of US Citizens? If that is true, we need to start sending our police to every country in the world to enforcement.
Count 4: The Bush administration authorized the round-up and detention in the United States of tens of thousands of immigrants on pretext grounds and held them without charge or trial in violation of international human rights law and domestic constitutional and civil rights law. |
Until the US Supreme Court declares the Patriot Act Un-constitutional or says these detentions violate the civil rights amendment, no laws have been broken.
Count 5: The Bush administration used military forces to seize and detain indefinitely without charges U.S. citizens, denying them the right to challenge their detention in U.S. courts. |
Please enlighten me on this case. Because all US citizens that I know of detained by US military forces in this war, have been charged and their cases are going through the US Court System.
Count 6: The Bush administration committed murder by authorizing the CIA to kill those that the president designates, either US citizens or non-citizens, anywhere in the world. |
Again, please provide the text of this charge. Has this happened yet and can you provide a incident? Just because in you opinion something is murder, does not make it so.
Destruction of the Global Environment |
As for these charges, please provide the treaty or laws that the US has signed which have been broken by President Bush.
I can not debate you without knowing what laws was broken and where these laws are coming from. You provide me with general observations that you think breaks some sort of law somewhere, but then don't provide any evidence or even the text of the law.
Please provide more info on these allegations.
