While I agree that any laws that attempts to govern our private bedroom activities are both unenforceable and a waste of legislation, too many people want to extend "privacy" to very public places.
I'm all for the concept of "what people do in the privacy of their own homes is none of our business". As long as all parties in question are comfortable with the activity, far be it for the law to tell them that they shouldn't be.
However, more and more, the idea of "privacy" and "self expression" are imposing themselves on the rest of us. Courts have defended public nudity and lewd "self expression" to the point that many public areas are no longer open to the public.
During "Gay Rights" celebrations, it is very common to see people walking around nude or nearly nude. "S&M" accessories are also common.
In San Francisco, a nudist won his case after being arrested for meditating a public park, completely nude.
In Vermont, a university has made a tradition of a "nude run" across a public bridge.
The retort to anyone who might complain is always, something like, "well if they don't like it, no one says they have to be there."
Well, how are they to tell me that I have no business being in a public area. In each of these cases, the individuals have decided that they have more right to break laws than the rest of us have to be in the park (or on the bridge) lawfully.
The saddest part is, braindead wastes of human flesh sitting on the bench, wearing black robes re-inforce the mindlessness by siding with the law breakers.
Apparently, if you call it "free expression", law breakers have much more rights than law abiding citizens.
