I am glad to see that the High Court did this.
We have lost the concept of "case by case basis" in this country. It has given way to the mindless "Zero Tolerance" or "Mandatory Sentence". Now we have people in prison for say, drug possession who are treated the same a dealer. The law language of most drug laws considers the dealing a more serious crime than possession (especially of small amounts of marijuana), but because of "Mandatory sentencing" the repeat possession offender is treated the same.
As far as the idea that mandatory sentencing clears up disparity from jurisdiction to jurisdiction, all I can say is, the Constitution was set up with the concept of "community standards" in mind. The authorities and responsibilities We, The People did not enumerate to the Federal Government in the Constitution went to State and local authority. In other words, the idea of a standard policy from jurisdiction to jurisdiction was never meant to happen.
I will agree with you that there will be some chaos from this decision. Correcting the shortsightedness of passed policies usually does get kind of messy. We'll see how Congress does, stepping up to the plate to curb the chaos. Until then, Great Article!!!!
P.S. Of course, now that I have gone public with my thoughts of "original intent" I can forget ever passing the litmus test for some Senators and Special Interest groups, should I ever be nominated for the Supreme Court! ;~D
