Actually it is. A transaction is legal only if it is between a customer and a licensed reseller. And unless your friend went and bought a license from Stardock/Calypso, I don't think he's legally able to sell you his game. Stardock/Ironclad offers customer support. It means it doesn't have to offer support to you.

I feel the need to reiterate again that software licenses are non-transferable and have always been that way. This is nothing new; it is industry standard, and as such is not required to be stated anywhere on the packaging. It is assumed that anyone purchasing software will know this, just like it's assumed that you know you need insurance to drive a car.
People have been buying second hand games for decades just like they have been buying other second hand goods for decades.
That's the norm. It's only very recently that shit like Impulse and Steam have started happening.
You got screwed, don't complain to SD/IC, complain to the game store. Maybe they'll change their practices to better ensure that this doesn't happen again in the future.
Again: how the fuck is the game store supposed to be aware of every DRM crippled game out there? They do their best to weed out such games (like Valve's), but they can't know everything. And SoaSE's publisher didn't exactly go out of their way to help them out.
