South Dakota abortion law goes to S.D. citizens for vote

What a concept!

What a concept, apparently one of the most strict anti-abortion laws in the country -- which makes exceptions only for the life of the mother, and not in cases of rape or incest -- which had been passed by the South Dakota state legislature and signed into law by the governor of that state, partly in hopes of inspiring a court case that may overturn the historical Roe v. Wade decision will be tested in the states ballot boxes, rather than in the court systems.

While many had expected the law to be challenged in court, opponents of the law have been taking a different tact and have apparently gotten to the point (required by processes, laws and rules for citizen referdum) that the law will go to a vote of the states citizens.

Meanwhile, (going by memory) other states have been working towards forming laws that would become the test cases as well.

One way or the other, the next several years will likely find Roe v. Wade getting turned on it's head or becoming "settled law" for many more years to come.

I should add here that if, and that should be a big IF, Roe v. Wade is ever over-turned, then the process that is happening in South Dakota may become the pattern for the land, as each state would create their own abortion laws with a myriad of potential restrictions depending on the state that the person seeking the abortion was in.

The irony is that the abortion factories pushed hard for the referendum!  Perhaps this law should be passed in every state, so that the citizens of every state could then vote on whether they want it or not.  I know that is anathema to the arbortion rights crowd, but it is the best solution to the whole abortion (read: Roe v. Wade) mess.

it was only a matter of time before roevwade was pushed before this more conservative SCOTUS.

I'm still a SD resident, as is my husband. I lived there for 9 years and can tell you that SD is a pretty staunch anti-abortion state.

As we were driving up there for the first time, we passed a number of anti-abortion billboards along I-90. Most of them had pictures of angelic looking babies on there, reminiscent of the gerber baby, and there were slogans like "I deserve a chance to live" and "please don't kill me". My husband looked at me and said "I guess we don't have to guess what their stance on abortion is, huh?".

I'll be very surprised if this gets nixed.
